Introduction

At Bellani, privacy is a priority. This Privacy Policy describes how MyBellani.com, Bellani LLC, and our affiliates (collectively, “Bellani”, “us”, “our”, or “we”) collect and use personal information from customers and other individuals (collectively “you”, “your” or “Users”) who access or use our websites, devices, online stores, applications, and any of our other sites, products, or services that that reference this Privacy Policy (together the “Services”). By using the Services, you are consenting to the practices described in this Privacy Policy.

We know that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This Privacy Policy sets forth our policy with respect to information that can be associated with or which relates to a person and/or could be used to identify a person (“personal information”) that is collected from consumers and third parties using our Services.

This Privacy Policy will help you better understand how we collect, use, and share your personal information. If we change our privacy practices, we may update this Privacy Policy. If any changes are significant, we will let you know (for example, through the Shopify admin or by email).

Our values

Trust is the foundation of the Shopify platform, which we use to provide products and services to you, and includes trusting us to do the right thing with your information. Three main values guide us as we develop our products and services. These values should help you better understand how we think about your information and privacy.

  • Your information belongs to you
We carefully analyze what types of information we need to provide our services, and we try to limit the information we collect to only what we really need. Where possible, we delete or anonymize this information when we no longer need it. When building and improving our products, our engineers work closely with our privacy and security teams to build with privacy in mind. In all of this work our guiding principle is that your information belongs to you, and we aim to only use your information to your benefit.
  • We protect your information from others
If a third party requests your personal information, we will refuse to share it unless you give us permission or we are legally required. When we are legally required to share your personal information, we will tell you in advance, unless we are legally forbidden.

What types of personal information we collect

  • Information You Give Us
When you purchase something from our store, as part of the buying and selling process, we collect the information you give us such as your name, address and email address. We receive and store any information you provide in relation to the Services. You can choose not to provide certain information, but then you might not be able to take advantage of many of the Services.
  • Automatic Information
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. We automatically collect and store certain types of information about your use of the Services, including information about your interaction with content and services available through the Services. Like many websites, we use “cookies” and other unique identifiers, and we obtain certain types of information when your web browser or device accesses the Services and other content served by us or on our behalf on other websites.
  • Information from Other Sources
We might receive information about you from other sources, such as updated delivery and address information from our carriers, which we use to correct our records and deliver your next purchase more easily.

For what purposes do we use your information

We use your personal information to operate, provide, develop, and improve the products and services that we offer our customers. These purposes include:

  • Purchase and delivery of products and services.
We use your personal information to take and handle orders, deliver products and services, process payments, and communicate with you about orders, products and services, and promotional offers.
  • Provide, troubleshoot, and improve the Services.
We use your personal information to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Services.
  • Communicate with you.
We use your personal information to communicate with you in relation to the Services via different channels (e.g., by phone, email, chat).
  • Recommendations and personalization.
We use your personal information to recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with the Services.
  • Comply with legal obligations.
In certain cases, we collect and use your personal information to comply with laws. For instance, we collect from sellers information regarding place of establishment and bank account information for identity verification and other purposes.
  • Email updates and marketing.
With your permission, we may send you emails about our store, new products and other updates.
  • Fraud prevention and risks.
We use personal information to prevent and detect fraud and abuse in order to protect the security of our customers, Bellani, and third parties.

We only process personal information for these legitimate interests after considering the considerations and potential risks to your privacy—for example, by providing clear transparency into our privacy practices, offering you control over your personal information where appropriate, limiting the information we keep, limiting what we do with your information, who we send your information to, how long we keep your information, or the technical measures we use to protect your information.

We use techniques like “machine learning” (or “automated decision-making”) to help us improve our services. When we use machine learning, we either: (1) still have a human being involved in the process (and so are not fully automated); or (2) use machine learning in ways that don’t have significant privacy implications (for example, reordering how apps might appear when you visit the app store).

Your rights over your information

We believe you should be able to access and control your personal information no matter where you live. Depending on how you use MyBellani.com and Shopify, you may have the right to request access to, correct, amend, delete, port to another service provider, restrict, or object to certain uses of your personal information (for example, direct marketing). We will not charge you more or provide you with a different level of service if you exercise any of these rights.

If you buy something from MyBellani.com, which is a Shopify-powered store, and wish to exercise these rights over information about your purchase, you need to contact us directly at hello [at] mybellani.com or at the following address:

Bellani LLC

Attn: Chief Privacy Officer

Please note that if you send us a request relating to your personal information, we have to make sure that it is you before we can respond. In order to do so, we may ask to see documentation verifying your identity, which we will discard after verification.

If you would like to designate an authorized agent to exercise your rights for you, please email us from the email address we have on file for you. If you email us from a different email address, we cannot determine if the request is coming from you and will not be able to accommodate your request. In your email, please include the name and email address of your authorized agent.

If you are not happy with our response to a request, you can contact us to resolve the issue.

Where we send your information

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.  Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

How do we handle payments

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. For more insight, you may also want to read Shopify’s Terms of Service here or Privacy Statement here.

We are a company based in the United States, but we work with customers and process data about individuals across the world. To operate our business, we may send your personal information outside of your state, province, or country. This data may be subject to the laws of the countries where we send it. When we send your information across borders, we take steps to protect your information, and we try to only send your information to countries that have strong data protection laws.

Finally, while we do what we can to protect your information, we may at times be legally required to disclose your personal information (for example, if we receive a valid court order).

How do third parties handle your personal information

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Use.

Does Bellani share your personal information

Information about our customers is an important part of our business, and we are not in the business of selling our customers’ personal information to others. We share customers’ personal information only as described below:

  • Transactions involving Third Parties
We make available to you services, products or applications provided by us and third parties for use on or through the Services. You can tell when a third party (other than Shopify) is involved in your transactions, and we share customers’ personal information related to those transactions with that third party.
  • Third-Party Service Providers
We employ other companies and individuals to perform functions on our behalf. Examples include online hosting of our store by Shopify, fulfilling orders for products or services, delivering packages, sending mail and email, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, scoring, assessing and managing credit risk, and providing customer service. These third-party service providers have access to personal information needed to perform their functions, but may not use it for other purposes.
  • Business Transfers
As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy (unless, of course, the customer consents otherwise). Also, in the unlikely event that Bellani LLC or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.
  • Google Analytics
Our store uses Google Analytics to help us learn about who visits our site and what pages are being viewed.
  • Protection of Amazon and Others
We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Bellani, our users, or other third parties. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Other than as set out above, you will receive notice when personal information about you might be shared with third parties, and you will have an opportunity to choose not to share the information.

How we protect your information

Our teams work tirelessly to protect your information, and to ensure the security and integrity of our platform. We work to protect the security of your personal information during transmission by using encryption protocols and software.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. You can find more information about the security measures incorporated in our platform as implemented by Shopify at https://www.shopify.com/security.
